This
appeal raises an issue decided in a judgment delivered
contemporaneously with this judgment.
The
issue of the jurisdiction of the High Court to hear this matter was
decided by this Court in its judgment in CIVIL APPEAL NO.2 OF 2000,
i.e. SECRETARY TO CABINET AND OTHERS V. ZWANE. For the reasons set
out in that judgment this

Court
also finds that the High Court had jurisdiction to hear the
application brought by the Respondent.
This
was the only challenge raised by the Appellants before us against the
judgment of the High Court. It follows that the appeal is to be
dismissed with costs.
It
is ordered accordingly.
